Is cannabis legal in Oklahoma?

Recreational cannabis use in Oklahoma is illegal. But, since State Question 788, the state has, with some back and forth, reduced its formerly rather extreme position on cannabis possession:
Once, the sentences handed down from the benches of Oklahoma’s judges for possession of drug paraphernalia – as well as of incredibly small quantities of cannabis – were notably hard-line even by comparison with other conservative states.
Up until 2016, minimum sentencing was mandatory and maximum sentencing harsh. These days, the “simple possession” rule is in force in Oklahoma City and the maximum fine for the possession of cannabis paraphernalia is $50.
In the state as a whole, even unlicensed “simple possession” of marijuana of 1.5 ounces or less comes with a maximum fine of $400 and no risk of jail time as long as a medical reason is provided.
Medical Marijuana in Oklahoma
Possessing cannabis for medical reasons is legal in Oklahoma as long as you have a valid medical marijuana license. In order to apply for a license, you need:
- Adults: can gain a medical marijuana license if they have a recommendation from a board-certified physician. Most other states have a list of qualifying conditions. But Oklahoma leaves it down to individual physicians to decide what disease or disorder qualifies.
- Minors: require two physicians as well as the permission of their parent or guardian

The only exception to this is federal land. Medical marijuana is still illegal under federal law, so even licensed users can be prosecuted if they are on federal lands. Federal lands include military bases as well as land which falls under the purview of the Department of Agriculture or National Park Service. Tribal trust lands also disallow the smoking of medical marijuana even with a valid license.
Is THC oil legal in Oklahoma?
At one point, Oklahoma had a low-THC law in place which restricted cannabis products to containing less than 0.3% THC.
The only exceptions to this rule were the FDA-approved treatments for children with two types of epilepsy (Lennox-Gastaut Syndrome and Dravet Syndrome) and adults with severe epilepsy, multiple sclerosis or paraplegia-induced spasticity, wasting syndrome or intractable nausea and vomiting.
Now, however, the laws around State Question 788 mean that with a valid medical marijuana license you can:
- Possess up to three ounces of medical marijuana
- Have up to eight ounces of medical marijuana in your home
- Grow up to six plants and six seedlings
- Buy marijuana in plant format, in edibles and in concentrates such as THC oil
- Own up to 1 ounce of marijuana concentrates
- Own up to 72 ounces of marijuana edibles
